<br />MINUTES <br />SPECIAL CITY COUNCIL MEETING <br />JUNE 12, 1984 <br />A special meeting of the Falcon Heights City Council was called to order at <br />7:00 P.M. <br />Mayor Eggert, Councilmembers Ciernia, Baldwin, Hard, and Chestovich. Also PRESENT <br />present were Attorney Van de North, Engineer Schunicht and Secretary Chenoweth. <br />None. ABSENT <br />Councilmember Hard moved, seconded by Mayor Eggert, that the Consent Agenda CONSENT <br />be approved as presented. Motion carried unanimously. AGENDA <br />APPROVED <br />~F <br />1. Licenses - See Attached List <br />LJ <br />[] <br />Mayor Eggert moved, seconded by Councilmember Hard, that the Minutes of MINUTES OF <br />May 23, 1984 be approved as presented. Upon a vote being taken, the following 5/23/84 <br />voted in favor thereof: Mayor Eggert, Councilmembers Baldwin, Hard and APPROVED <br />Chestovich, and the following voted against the same: None. Councilmember <br />Ciernia abstained. Motion carried. <br />Council agreed to add the appointment of a Larpenteur/Spelling Redevelopment <br />Committee to the agenda. <br />Mayor Eggert presented a request from Warren E. Elert, owner of the apart- <br />ment building at 1510 W. Larpenteur, that Council reconsider payment of <br />$78.00 for sewer clean out. Mr. Elert reviewed his problem with the sewer <br />back-up and requested that the City reimburse him for $78.00, the amount <br />charged by the sewer cleaning firm, as he felt the problem was in the City <br />line. Mayor Eggert explained Council's stand on these items since it is <br />difficult to assign responsibility for improper items placed in the sewer. <br />Only if the City line has broken the or other damage which would cause <br />back up, does the City consider payment of any charges. <br />WARREN ELERT <br />SEWER BACK-UP <br />1510 W. <br />LARPENTEUR <br />Lowell Lundy, 1853 Moore, was in attendance and requested that Council LOWELL LUNDY <br />consider blacktopping a five foot strip in the walkway easement abutting 1853 moore <br />his property, as he felt it would prevent the walkway from becoming unattractive <br />after use. He indicated that Good Value is willing to install chain link <br />fence along the walkway. Engineer Schunicht stated that the cost of the PARK WALK-WAY <br />project would be between $500 and $1,000 and could be included in the 1984 <br />sealcoating bid. Following a discussion regarding the possibility of <br />vacating 2-1/2 feet of the easement to each of the two abutting neighbors, <br />and who should pay for the blacktopping, Councilmember Ciernia moved, seconded <br />by Mayor Eggert, that the City Attorney determine whether or not to vacate <br />the walkway or some method of restricting the easement, and that the Clerk <br />Administrator negotiate with Good Value and the residents in regard to the <br />installation and payment for the blacktopping and fencing. Motion carried <br />unanimously. <br />
