MINUTES <br />REGULAR CITY COUNCIL MEETING <br />APRIL 10, 1985 <br />PAGE 3 <br />~~ <br />Attorney Gasteazoro presented a redraft of the proposed liquor LIQUOR <br />ordinance and explained the changes made as requested by Council at ORDINANCE <br />the March 20th meeting, and explained the restrictions placed on DISCUSSION <br />entertainment. In the absence of Councilmember Ciernia, Secretary <br />Chenoweth presented Mr. Ciernia's concern that either the ordinance or <br />the conditional use granted to the Lido Cafe should indicate the ratio <br />of liquor to food. Attorney Gasteazoro explained that the definition of <br />bona fide club and restaurant in the ordinance controls that, however, <br />if Council wishes it more stringent, she would need guidance to draft <br />the change. <br />Mayor Eggert stated that he had spoken to the Labalestras and they LIDO <br />have decided to pursue a modified "Scheme E" and will not be requesting CAFE <br />parking on the Croft property, and will be downgrading the number of UPDATE. <br />seats. Mayor Eggert and the Attorney will meet with the Lido owners <br />on April 16, 1985 to redraft the development agreement. <br />Council again addressed the matter of the liquor ordinance discussing LIQUOR <br />at length such items as entertainment, number of licenses to be ORDINANCE <br />issued, phasing out 3.2 feet on sale except in restaurants, ratio of DISCUSSION <br />food to liquor, and limiting hours of operation. CONTINUED <br />Ted Meyer, 1710 St. Mary's, felt entertainment should be restricted to TED MEYER, <br />prohibit it being a detriment to the City, that the ratio of food to 1710 ST. <br />liquor should be established, there should be a more explicit definition MARY'S <br />of restaurant, and felt 3.2 beer licenses do no t enhance the City as <br />they bring in unwanted types. <br /> MEMO FROM <br />Jan Bykowski, 1745 St. Mary's, presented a memo from James Bykowski, 1745 JIM BYKOWSKI, <br />St. Mary's, requesting items to be required. by the ordinance (a copy of 1745 ST. <br />this memo is on file in the Clerk's Office). MARY'S <br />Lolita Keck, 1766 St. Mary's, commented on the residential nature of LOLITA KECK, <br />the community and questioned the need for such a large number of 1766 ST. <br />liquor/beer licenses. MARY'S <br />Joan Schrum, 1736 Fry, felt that establishing e arlier closing hours for JOAN SCHRUM, <br />establishments serving liquor would discourage "hard core" drinkers from 1736 FRY <br />coming to Falcon Heights. <br />Steve Reiter, 1746 Fry, asked if the section in the ordinance requiring STEVE REITER <br />a person to be in business six months before a liquor license is issued 1745 FRY <br />had been deleted, and Attorney Gasteazoro repli ed that it had not. <br />Following the discussion, the City Attorney was directed to change the <br />number cf licenses from six to five, and to check into the possibility of <br />limiting the hours of lounge operation to the period of time when the <br />kitchen is in operation as suggested by Ms. Schrum. <br />Attorney Gasteazoro presented her memorandum dated April 1, 1985 relating <br />to the watershed agreement discussed at the March 27th meeting. After <br />a short discussion, Mayor Eggert moved, seconded by Councilmember Hard, <br />that Resolution R-85-12 be adopted.
