He also presented a letter <br />f <br />T <br />rom <br />homas M. Keller assuring that the addendum was included in the <br />bid <br />S <br />. <br />chunicht recommended that Council accept the low bid from <br />Austin P. Keller Construction Co. Councilmember Chenoweth moved <br />, <br />seconded by Councilmember Baldwin, that Resolution R-85-37 be adopted <br />. <br />Motion carried unanimously. <br />RESOLUTION R-85-37 RESOLUTION <br />R-85-37 <br />A RESOLUTION AWARDING AUSTIN P. KELLER CONSTRUCTION <br />CO. THE CONTRACT FOR IMPROVEMENTS - LARPENTEUR AVENUE/ <br />COFFMAN ST./TATUM ST./LINDIG ST./FORD AVE. R.O.W. <br />Acting Mayor Ciernia presented a letter dated June 15, 1985 from D. F. D. F. <br />Swanson, 1824 Asbury, regarding a diseased elm tree which he has been SWANSON, <br />directed to remove. Mr. Swanson felt the removal of the tree is a City 1824 ASBURY <br />obligation as when the tree was planted in 1942_ he had to have the REQUEST <br />location approved by the governing body. He also commented on the fact THAT CITY <br />that other trees in line with his (1830 and 1834 Asbury) were removed by REMOVE <br />the City, and until the 1970's the trees were trimmed by the City. Clerk TREE ON HIS <br />Administrator Barnes explained that following a dispute over the trees PROPERTY <br />at 1930 and 1834 Asbury, the City Engineer surveyed the area to determine DEFERRED <br />whether they were on private or public property, and the tree at 1824 <br />Asbury definitely is on Mr. Swanson's property. Councilmember Baldwin <br />was of the opinion that if the original intent was to plant the trees <br />on the City boulevard, and if the City maintained them, that the City <br />should be responsible for removal. Following the discussion, the Clerk <br />Administrator was directed to determine how far the tree is from the lot <br />line, and how many trees remain which were mistakenly planted on private <br />property. The matter was deferred until the additional information is <br />obtained. <br />Attorney Van de North reviewed the letter dated June 26, 1985 from John LIDO CAFE <br />Labalestra, Lido Cafe, Inc., indicating that the Lido has decided not UPDATE - <br />to expand their facility in Falcon Heights, but will move to another COUNCIL <br />location. Since the Attorney had been directed to draft a resolution RESCINDS <br />approving the conditional use for the Lido, the City was considering PREVIOUS <br />vacating a portion of St. Mary's St., and possible condemnation of a ACTION <br />private alley for the Lido project, Mr. Van de North felt it appropriate RELATING <br />to officially close the subject with the understanding that the Lido TO <br />could re-apply if they so desire. Following the discussion, Councilmember CONDITIONAL <br />Chenoweth moved, seconded by Acting Mayor Ciernia, that Council rescind USE, ETC. <br />previous action taken in regard to the conditional use and any other <br />related legal action, due to the facts in Mr. Labalestra's letter. Motion <br />carried unanimously. <br />
