~.~i <br />A4IMUTES <br />SPECIAL CITY COUNCIL MEETING <br />DECEMBER 15, 1982 <br />PAGE 2 <br />:~ayor Vdarkentien advised Council that he had received a complaint from <br />Pdrs.Clemment, the neighbor directly west of Hoffman Corner Oil Co., re- <br />garding the debris which was being scattered around and also because <br />people were driving thru the property to get from the pay phone out <br />to the alley on the west side of the building. Clerk Administrator <br />Barnes referred to a letter from Lloyd A. Urban, owner of Hoffman Corner <br />Oil Co., stating that the telephone booth will be moved to the Hamline <br />side of the lot and that employees will be instructed to daily inspect <br />the lot for any debris. After a discussion regarding the citation that <br />was issued for operating without a license, Councilmember Ciernia moved, <br />seconded by Councilmember Chestovich, that consideration be given for <br />cancellation of the citation by the court. ~~totion carried unanimously. <br />Clerk Administrator Barnes was requested to make sure that HCO keeps in <br />compliance with debris removal, that the phone booth is located properly <br />and that a different type of barrier be installed between the station <br />and the residence to the west. <br />Council discussed the Planning Commission's concerns that they were <br />being by-passed by Council action regarding parking requirements <br />for multiple dwellings as stipulated in Ordinance ;#191.. Mayor ~ti'arkentien <br />made a motion to amend the ordinance to regxire two parking spaces instead <br />of 2-1/2 spaces. The motion died for lack of a second. Attorney <br />Swanson pointed out that changes in ordinances should be referred <br />to the planning Commission prior to Council approval. The Planning <br />Commission then has 60 days to either approve or disapprove. The <br />matter was tabled to allow the planning Commission to review the <br />ordinance. <br />A variance reouest from Grace Lai for Lot Ili, Block 1, Labalestra park <br />was reviewed by James A. Hiltz of Graphic Designs Architects. The <br />plan submitted will provide 13 parking spaces v~ich meets the new 2-1/2 <br />car oarking requirement. Mayor ti~arkentien moved, seconded by Council- <br />member Ciernia, to grant the variance request subject t o the sire <br />Chief's approval (approval was recommended by the planning Commission <br />at the December 6th meeting). Upon a vote being taken, the following <br />voted in favor thereof ; i~,2ayor ~'~arkentien, Councilmembers Chestovich <br />and Ciernia and the following voted against the same: Councilmember <br />Eggert due to the fact that he felt there would not be ample roadway <br />for garbage trucks, emergency vehicles, etc. Motion carried. <br />COMpLl~NT <br />REGARDING <br />PHONE BOQTH <br />& DEBRIS AT <br />HCO STATION <br />ORDINANCE #191' <br />DISCUSSION <br />TABLED <br />GRACE LAI, <br />LOT 14, BLK. <br />VARIANCE <br />GRANTED <br />?viayor ~~arkentien again moved to reverse Ordinance 191. ~,~otion died for ORDINANCE #19 <br />lack of a second. Councilmember Eggert moved, seconded by Councilmember REFERRED TO <br />Ciernia, that Ordinance 191.E be referred t o the Planning Commission for pLAh~tING <br />their recommends#,i on prior to any further publication. motion carried CO"~~TISSION <br />unanimously. <br />Councilmember Eggert moved, seconded by Councilmember Ciernia, that CABLE TV <br />X2,000 of the X10,500 check remitted to the City by Group W Cable UPDATE <br />Company be remitted t o the North Suburban Cable Commission as the <br />City's portion of cost in operation of the Commission. The remaining <br />x$,500 was for reimbursement to the City for Cable TV related costs <br />over the east few years. °~otion carried unanimously. Councilmember <br />
