Councilman Black moved, seconded by Councilman Ecklund, CONDITIONAL USE PERMIT that the request for a conditional use permit by Richard 1841 ASBURY Elhardt of 1841 Asbury be taken frown the table. Motion carried. Present for the discussion were Mr. Elhardt and Mr. Steven Nelson, the attorney representing Mr. and Mrs. John Struble, 1851 Snelling Drive. Both parties stated that as of this time, the ease has not been settled,, and Mr. Nelson stated that his clients have instructed him to pursue the matter into district court if need be. He also suggested that the Council wait for the dispostion of the case before making a decision on the matter of the conditional use. Councilwoman Stocker moved, seconded by Councilman Black, that this matter be tabled until some decision has been made by the parties involved pertaining to the res- trictive deed clause, and until the Council is presented with a signed agreement between the property owners or a court order.. Motion carried. Mayor Warkentien moved, seconded by Councilman Hlack, APPLICATION - that the application for a volunteer fireman by Thomas VOLUNTEER FIREMAN Bianchi, be tabled until there is an opening on the Falcon Heights Fire Department upon recommendation of the City Attorney. Motion carried. The increases in the natural gas and electrical rates GAS & ELECTRIC RATES by Northern States Power, were noted. The designation of the animal. control .firm was deferred ANIMAL CONTROL FIRM until the next meeting. The report on the ~.oeal Government Study Coaanission was noted and the Council requested copies for their own use. Fire reports numbers 1, 2 and 3 were noted. The Sheriff's report for December, 1973, was noted. Councilman Ecklund moved, seconded by Mayor Warkentien, to authorize Clerk-Administrator Barnes to construct a platform for the council chambers, in reference to his report on the estimated cost. Motion carried. GOVII~NMENT STUDY COMMISSION FIRE REPORTS SHERIFF'S REPORT COUNCIL PLATFORM Councilwcm4an Stocker moved, seconded by Councilman Black, GENERAL PAYROLL to approve the general payroll for the second half of January, 1974, in the amount of $3,268.66.
