2 732 <br /> increase the size of an existing attached garage at <br />Variance application 11169 West Idaho Street (which property is zoned R 1), <br />-garage Ray Arth - which variance, if granted would create a side-yard.. <br />11G69 W. Idaho: setback of only three (3) feet instead of the required <br />(continued) 7~ feet, and <br />WI~REAS, the Village of Falcon Heights has <br />referred, said request for a variance. permit to the <br />Planning Commission of the Village of Falcon Heights, <br />and said Planning Commission has recommended that <br />said variance request be granted by report dated <br />June 11, 1968, a copy of which is on file in the <br />Clerks Office and incorporated herein by reference, <br />and <br />WHEREAS, the Village Council of the Village of <br />Falcon. Heights has reviewed the request for said <br />variance permit, and has reviewed the report of the <br />Planning Commission, <br />NONT, THEREFORE, BE IT RESOLVED by the Falcon <br />Heights .Village .Council. that <br />1. The V-illage of Falcon Heights findst <br />(a) that practical difficulties and particular <br />hardships are in the way of carrying out the <br />strict letter of the regulations of this ordinance <br />from which the applicant seeks a variance; <br />(b) that the proposed location of the <br />garage.is in keeping wi th the character and <br />development of the immediate neighborhood; <br />(c) that the granting of the requested <br />variance a.s necessary for the preservation and <br />enjoyment of a substantial property right of the <br />applicant, and <br />(d) that the granting of the proposed <br />variance will not impair an adequate supply of light <br />and air to the-adjacent property, unreasonably increase <br />the congestion in the public streets, increase the <br />danger of fire, endanger the public safety, unreason- <br />ably diminish or impair established property values <br />in the surrounding area, or in any other way impair <br />health, safety, comforts, morals or in any other <br />respect be contrary to the intent of the Zoning <br />Ordinance or the Comprehensive Plan of the Village. <br />2• The Village Clerk and Village Zoning Admin- <br />istrator are hereby empowered to issue said variance <br />permit subject to the condition that the final plans <br />for construction of said garage extension be reviewed <br />by the Village Engineer before actual construction <br />begins. <br />The motion for the adoption of the foregoing resolution <br />
