190l~ <br />1. Said variance permit be and is hereby <br />granted, conditioned as follows: <br />2. Council grants without further applies <br />cation on the part of applicant, Ray Schommer, <br />a pool permit and license under the provisions <br />of Ordinance No. 65 which amends ordinance No. <br />t.~. of the Village of Falcon Heights. Because <br />of the navel and unique swimming pool operation <br />contemplated by applicant, said pool permit and <br />license is expressly declared to be an annual <br />permit, to be issued on an annual basis by the <br />Falcon Heights Village Council. It is further <br />conditioned that said pool will be constructed <br />of such material as to be placed on the surface <br />of the ground, being removable and severable <br />from said real estate. It is the understanding <br />of the applicant and the Village Council that <br />the pool license and permit contemplates an <br />annual seasonal operation of a swimming pool <br />for the limited purpose of demonstrating swircr- <br />ming pools and other articles or materials <br />directly reaped to the operation or maintenance <br />of swimming pools, <br />3. Prior to the issuance of said var- <br />iance and swimming pool license permit, said <br />applicant shall enter into an agreement with <br />the otivner of the real estate described above <br />to have the parking space on said real estate <br />surfaced to comply with the provisions of <br />Ordinance No, 6l~, Section 1.li.2, Subdivision <br />3.t~ which provides, <br />"All of the area intended to be <br />utilized for parking space and <br />driveways shall be surfaced with <br />a material to control dust and <br />drainage subject to the approval <br />of the Village Council, except <br />parking areas for less than <br />three vehicles.t~ <br />!~. The following health and safety <br />measures shall also be required to be obser- <br />ved by said applicant: <br />A. Retractable steps and a door <br />on the swimming pool that can be locked when <br />the same is not in use. <br />B. Said pool should not be used <br />for public swimming purposes. <br />
