public health, safety, convenience and welfare of the citizens and residents of the city. <br />(b) Conformance. No structure or improvement shall be erected, converted, enlarged, <br />reconstructed or altered, and no structure or land shall be used for any purpose nor in any <br />manner that is not in conformity with the provisions of this chapter. <br />(c) District uses. The uses as set out in the provisions for the various districts shall be the uses <br />allowed under this chapter. <br /> <br />(Code 1993, § 9-2.01) <br /> <br />Sec. 113-5 - Nonconforming uses, buildings and structures <br />(a) Nonconformities . Any nonconformity, including the lawful use or occupation of land or <br />premises existing at the time of the adoption of an additional control under this chapter, may <br />be continued, including through repair, replacement, restoration, maintenance, or <br />improvement, but not including expansion, except as specifically provided in this chapter, <br />unless: <br />(1) The nonconformity or occupancy is discontinued for a period of more than one year; <br />or <br />(2) Any nonconforming use is destroyed by fire or other peril to the extent of greater than <br />50 percent of its market value, and no building permit has been applied for within 180 <br />days of when the property is damaged. In this case, a municipality may impose <br />reasonable conditions upon a building permit in order to mitigate any newly created <br />impact on adjacent property. <br />Any subsequent use or occupancy of the land or premises shall be a conforming use or <br />occupancy. <br />(b) Unlawful use, buildings, and structures. No unlawful use of property existing on the <br />effective date of the ordinance from which this chapter is derived nor any building or <br />structure which is unlawfully existing on such day shall be deemed a nonconforming use or <br />a nonconforming building or structure. <br />(c) Nonconforming structures under construction. Any nonconforming structure that is ready <br />for or under construction on the effective date of the ordinance from which this chapter is <br />derived may be completed and occupied in accordance with the requirements of any valid <br />building permit issued therefor prior to such effective date. <br />(d) Change from one nonconforming use to another. A nonconforming use may be changed <br />only to a use permitted in the district in which it is located; except that if no structural <br />alterations are made, a nonconforming use of a building may be changed to another <br />nonconforming use of the same or a more restrictive classification, and provided such <br />change is approved by the city council. Once changed to a conforming use, no building or <br />land shall be permitted to revert to a nonconforming use. A nonconforming use, all or <br />partially conducted in a building or buildings, may be changed to another nonconforming <br />use only upon determination by the city council, after a public hearing, that the proposed <br />new use will be no more detrimental to its neighborhood and surroundings than is the use it <br />is to replace and that there is no conforming use available for the building or buildings. In <br />determining relative "detriment," the planning commission shall take into consideration, <br />among other things, traffic-generated, nuisance characteristics, such as emission of noise,
