<br />Meeting called to order at 7:40 P.M. and minutes of regular meeting,
<br />August 11 and of special meeting August 1lt, 1953, were heard and approved as read.
<br />deeds: After discussion, Lindig moved that the weeds be cut along Village
<br />streets and on the lots owned by the Village at Idaho and Snelling.

<br />Application for building permit dated ~4ugust 21t, 1953, was received from
<br />Ivar Johnson, contractor, Minneapolis, for construction of concrete and
<br />brick building, 65x85; estimated cost, x+37,000.00, on Lots 8 and 9, at
<br />Snelling and Zarpenteur avenues, the Cross Roads Addition. After dis-
<br />cussion, Lindig moved that said application for building permit be
<br />approved. Seconded by Stewart and carried unanimously.
<br />Shavor moved that in view of the Planning Commission's recommendation
<br />as recorded in the .minutes of August !~, 1953, that the previous action
<br />of the council on June 21~, 1953, denying the Mock petition, be recon-
<br />sidered. Seconded by Stewart and discussion was called for, Shavor
<br />spoke generally with respect to the detrimental effects of "spots zoning
<br />and pointed out that having commercial property does not give the owner
<br />a vested right. Stewart urged that the council give consideration as
<br />to what is said in this connection in the League of Minnesota Municipalities
<br />publication titled "Zoning, A Guide for Minnesota Cities and Villages.
<br />It was then decided after some discussion to hear Treasurer Van Howes.
<br />Van Hoven said the status of the whole matter was changed when the
<br />council by a unanimous vote referred the Mock petition to the Planning
<br />Commission for study and report. Subsequently, he said, this citizens'
<br />committee, acting in what they felt was the best interests of the Village,
<br />submitted their report and recommendation to the council; therefore,
<br />Van Hoven felt, there was a moral obligation at least for any council
<br />member who voted. against the citizens' committee's recommendation to
<br />explain his position in doing so. Lodahl then stated that he felt he
<br />was voting in the beat interests of Falcon Heights because Larpenteur
<br />avenue was a commercial street and that the property should remain
<br />commercial.
