FALCON HEIGHTS CITY COUNCIL MINUTES <br />• March 24, 2004 -2- <br />Refuse Collection -Public Hearin on Resolution of Intent (continued) <br />The presentation by Deb Jones, Planning/Zoning/Code Enforcement Coordinator, and Staff <br />Liaison to the Solid Waste Commission is outlined below. <br />Reconsidering f~'~anized collection of Trash <br />What is organized collection? <br />"`organized collection" means a system for collection solid waste in which a specified collector <br />or a member of an organization of collectors, is authorized to collect from a defined geographic <br />service area or areas some or all of the solid waste that is released by generators for collection. <br />-1klnnesota Statute I l SA.94 <br />Minnesota Statute 11SA.94 <br />A city or town ar county may organize collection after going through. the process defined in <br />the statute. <br />IVlunieipal service -not under consideration in Falcon Heights <br />- Bidded contract, franchise, or other means <br />• City must invite participation of "interested persons,'} including haulers <br />Minnesota Statute 115A.94 <br />~! Process: 6 months + <br />- City must hold a public hearing <br />-~ City must pass a resolution of intent <br />- Three months for planning and proposals <br />-- Three months for discussion with licensed haulers who have expressed. an interest <br />- At the end of six months the City mar propose implementation <br />Minnesota Statute 115A.94 <br />^ Subdivision 7 grants <br />To cities <br />^ Authority to engage in anticompetitive conduct to the extent necessary to plan and <br />implement their chosen system <br />• Immunity from liability under state laws regulating trade or commerce <br />To waste haulers or organizations of waste haulers who participate <br />^ Authority to engage in anticompetitive conduct to the extent necessary to plan and <br />implement, under active supervision. of the city <br />^ Immunity from liability (as above} <br />
