86199 <br />• WHEREAS, the City is about to perform storm water treatment pond, <br />storm sewer, grading, watermain, concrete walk, bituminous surfacing, <br />and landscaping construction and other associated construction upon, <br />along and adjacent to Trunk Highway No. 51 (Snelling Avenue) from <br />West Idaho Avenue to West Iowa Avenue within the corporate City <br />limits in accordance with City-prepared plans, specifications and <br />special provisions designated by the City as State Aid Project No. <br />124-050-04 and by the State as State Project No. 6216-119 <br />(T.H. 51=125); and <br />WHEREAS, the City has requested participation by the State in the <br />costs of the storm water treatment pond, storm sewer, grading and <br />bituminous surfacing construction; and <br />WHEREAS, the State is willing to participate in the costs of the <br />• storm water treatment pond, storm sewer, grading and bituminous <br />surfacing construction and associated construction engineering in an <br />amount not to exceed $54,000.00, based on a contributing flow rate of <br />38%, as hereinafter set forth; and <br />WHEREAS, Minnesota Statutes Section 161.20, subdivision 2 authorizes <br />the Commissioner of Transportation to make arrangements with and <br />cooperate with any governmental authority for the purposes of <br />constructing, maintaining and improving the trunk highway system. <br />IT IS, THEREFORE, M(TTUALLY AGREED AS FOLLOWS: <br />ARTICLE I - CONSTRUCTION BY THE CITY <br />Section A.
