as a period of 12 full months of active service in the Fire Department. Service pensions <br />will be prorated monthly for fractional years of service pursuant to Minn. Stat. § <br />424A.02, Subd. 1. <br />Section 2.12. Domestic Relations Order. Any judgment, decree or order (including <br />approval of a property settlement agreement) that complies with the provisions of Minn. <br />Stat. §§5518.58, 518.581, or 518.611. <br />Section 2.13. Account. the record of the amounts credited to an individual under the <br />plan, including amounts transferred from the defined benefit pension plan, plus <br />contributions, forfeitures and investment income allocated under the plan. <br />Section 2.14. Accounting date. December 31. <br />Section 2.15. Contribution. The additions to the special fund from fire state aid and/or <br />municipal contribution. <br />Section 2.16. Plan Year. The twelve month period commencing on January 1 and ending <br />December 31. <br />Section 2.17. Valuation. A determination made by an investment manager, C.P.A., <br />actuary or other professional as designated by the board. A valuation shall include a <br />calculation that determines the fair market value of the total assets. The fair market value <br />shall be determined based on the value at which the investments could be sold on an open <br />• market. The board of trustees will determine the market value of any assets for which <br />there is no readily determinable market value, upon consultation with the same <br />designated professional. Where appropriate, the board of trustees shall have the <br />discretion to use an independent appraiser to value the investments. The determination <br />as to fair market value of investments shall not include selling those investments merely <br />to determine their saleable value, and any transaction that shall result in churning of the <br />account or other fraudulent activity, in order to conduct the valuation is prohibited. The <br />professional shall not sell assets during the valuation process unless specifically directed <br />to do so by the board. This definition also applies to the process of revaluing members' <br />accounts and any other appropriate sections of these bylaws or activities of the board <br />where assets or members' accounts are "valued". <br />Article III -Membership <br />Section 3.1. Eligibility for membership. All active members of the Falcon Heights Fire <br />Department including probationary members except members of the PERA Police and <br />Fire Fund who are eligible for regular salary or overtime salary during volunteer activity <br />are eligible for membership in the Falcon Heights Fire Department Relief Association. <br />Application for membership shall be made in writing on a form supplied by the Secretary <br />of the Relief Association. The application shall be reviewed for compliance with state <br />• statutory and plan requirements. If approved, the applicant shall be entered on the <br />membership rolls <br />39 <br />
