An applicant shall not be considered under a disability <br />unless the member furnishes adequate proof of the existence thereof. <br />An applicant's statement as to pain or other symptoms will not alone be <br />conclusive evidence of disability as defined in this section. <br />6. Grievance Procedure. If the applicant for disability benefits feels the <br />he/she has been aggrieved by any action of Board, the member shall, <br />within sixty (60) days from notice of such action of the Board, file <br />written objections and the reasons thereof with the Board and shall be <br />allowed to appeal the determination pursuant to the Procedure for <br />Review in these bylaws. <br />Article XII -Early Vesting Provision <br />Except as provided in section 2, in the event a member with five (5) years or more but <br />less than twenty (20) years of active service on the Fire Department resigns or otherwise <br />becomes a nonmember, that person shall be entitled to the following benefits that <br />represents the nonforfeitable portion of: <br />Completed Years of Service Nonforfeitable Percentage of Pension Amount <br />40 percent <br />6 44 percent <br />7 48 percent <br />8 52 percent <br />9 56 percent <br />10 60 percent <br />11 64 percent <br />12 68 percent <br />13 72 percent <br />• 14 76 percent <br />s~ <br />
