Section 15.2. Garnishment, judgment or legal process. No service pension or ancillary <br />• benefits paid or payable from the special fund of a relief association to any person <br />receiving or entitled to receive a service pension or ancillary benefits shall be subject to <br />garnishment, judgment, execution, or other legal process, except as provided in Minn. <br />Stat. §§518.58, 518.581, or 518.611. <br />Section 15.3. Assignments. No person entitled to a service pension or ancillary benefits <br />from the special fund of a relief association may assign any service pension or ancillary <br />benefit payments, nor shall the association have the authority to recognize any <br />assignment or pay over any sum which has been assigned. <br />Section 15.4. Limitations on Ancillary Benefits. Following the receipt of a lump sum <br />death benefit neither a member's surviving spouse nor estate is entitled to any other or <br />further financial relief or benefits from the Association. <br />Section 15.5. Limitations on Rejoining the Fire Department, and Thereby Rejoining the <br />Association. All members who retire or otherwise separate from active service and are <br />paid a benefit from the relief association are encouraged to consider and weigh their <br />decision carefully prior to separation from service. Such separation will be considered <br />permanent per state law. A member who has retired, and has taken his or her <br />distribution, shall not be eligible for reinstatement as a member. In addition, pursuant to <br />Minn. Stat. 424A.02, Subd. 9(b), the member shall not be eligible to accrue further active <br />service and shall: <br />• 1. Rea an ensions that have been aid to the s ecial fund <br />p Y Y p p p of the association <br />and such pension benefit amounts shall immediately be repaid, <br />2. The amount shall be repaid within sixty (60) days of reinstatement. <br />The Association does not take responsibility for any penalties incurred on distribution <br />options such as IRAs or cash payments due to the fact that distributed benefits must be <br />repaid to the association. <br />Article XVI -Amendments <br />Section 16.1. Amendments. The Bylaws of this Association may be amended at any <br />regular meeting by a vote oftwo-thirds (2/3) of the members present, provided that <br />members present constitute a quorum and provided that notice of any proposed <br />amendment shall be given by reading the same at a regular meeting next preceding that <br />upon which such amendment is acted upon. A further stipulation pertaining to any <br />change in the Bylaws relative to that purpose, amount or manner of disbursements, by the <br />Association shall obtain the approval of a three-fifths (3/5) majority of the members of <br />the City Council of the City of Falcon Heights. <br />• <br />'° S4 <br />
