Platzek <br />Falcon Heights Prosecuting Attorneys <br />SUBJECT: October 8, 2003, Falcon Heights City Council Meeting <br />Presentation Update <br />• DATE: November 18,.2003 <br />Thank you for the opportunity to speak to the Falcon Heights City Council on October 8, 2003, <br />regarding Minnesota's DWI laws. This memorandum is a follow-up to that presentation. <br />Between January 1, 2003, and October 31, 2003 our office has prosecuted over 500 <br />misdemeanor crimes, as well as hundreds of petty misdemeanor offenses, for the City of Falcon <br />Heights. During that time, we also prosecuted 42 gross misdemeanor cases, which are initiated <br />when a formal complaint is issued by our office. 180 cases were scheduled for a pretrial <br />conference or omnibus hearing, and 49 cases were scheduled for a jury trial. Additionally, 46 <br />misdemeanor and petty misdemeanor cases were scheduled for a court trial. <br />As stated during the presentation, almost 1/3 of the gross misdemeanor cases prosecuted by our <br />office are Second- or Third-Degree DWIs. The remaining gross misdemeanor cases comprise <br />charges such as Driving After Cancellation as Inimical to Public Safety, Giving a False Name to <br />Police, Furnishing Alcohol to a Minor, Obstructing Legal Process with Force, and Interference <br />with a 911 Emergency Call. <br />A majority of misdemeanor cases in Falcon Heights are license and insurance offenses, such as <br />Driving After License Revocation or Suspension, and Operating an Uninsured Motor Vehicle. <br />Other common misdemeanor offenses include Domestic Assault, Fourth-Degree DWI, Failure to <br />• Transfer Motor Vehicle Title, and both Falcon Heights and University of Minnesota ordinance <br />
