Planning Commission 2/4/03 Item 3 (continued) • Addition of a legal definition of a farmer's market to the definitions section of Chapter 9 • Addition of a provision for Interim Use Permits, to be added to Section 9-15. Our City Attorney advises that in Interim Use is the most appropriate kind for a farmer's market, and our current city code does not provide for this kind of use. An Interim Use must meet most of the conditions and standards set forth for a Conditional Use. This amendment sets general standards and requirements for any future Interim Use that may be allowed in the City Code. • Addition of a new subdivision for Section 9-9: "B-2", Limited Business District. The new Subdivision 7 lists legal Interim Uses in the B-2 zone. At this time only one such use is listed, the Farmer's Market. This section sets up specific criteria that a farmer's market must meet to get an Interim Use Permit. If the Planning Commission votes to recommend passage of the ordinance, the City Council will act on the recommendation at the Council's next regular meeting, February 12, 2003. ATTACHMENTS: 1. Copy of proposed Ordinance 03-02 amending certain sections of Chapter 9 of the City Code. 2. Legal notice of Public Hearing 3. Map of the Farmer's Market site in the north parking lot of Twin City Co-op Federal Credit Union 4. Notes from the Community Meeting on November 25, 2002 5. Copy of the cover letter sent to properly owners within 350 feet with the above legal notice. The map and proposed ordinance were also enclosed with this mailing. 6. Copy of the cover letter sent to all residents in the local neighborhood. They also received the legal notice, a copy of the ordinance, the map and notes from the November 25 meeting. ACTION REQUESTED: 1. Open the public hearing. 2. Take comments from the public. 3. Close the public hearing. 4. A motion to recommend that the City Council approve Ordinance 03-02. r~ U ~8
