CITY OF FALCON HEIGHTS <br />RAMSEY COUNTY, MINNESOTA <br />ORDINANCE NO. 03-03 <br />AN ORDINANCE AMENDING CHAPTER 5 <br />OF THE FALCON HEIGHTS CITY CODE <br />CONCERNING THE INDOOR DISPLAY OF FIREWORKS <br />AND USE OF PYROTECHNIC EQUIPMENT AND MATERIALS <br />THE CITY COUNCIL OF FALCON HEIGHTS, MINNESOTA ORDAINS: <br />SECTION 1. Section 5-1.02 of the Falcon Heights City Code is amended by <br />adding a subparagraph "E" to provide as follows: <br />E. INDOOR FIREWORKS DISPLAYS OR USE OF PYROTECHNIC <br />DEVICES. <br />1) Indoor use limited. It is unlawful to conduct any indoor fireworks <br />display or to use any pyrotechnic device including smoke pots, flash pots and <br />theatrical flash powder indoors if the structure or area in which the display or use <br />• is being conducted is not protected by an automatic fire suppression system. <br />This section shall apply to the use of fireworks or pyrotechnic equipment and <br />materials for ceremonial, theatrical and musical productions, but does not apply <br />to "Legal fireworks" as defined below. <br />2) Definition. For the purposes of this Section "legal fireworks" is <br />defined to mean: <br />ire or wood sparklers of not more than 100 grams of mixture <br />per item, other sparkling items which are nonexplosive and <br />nonaerial and contain 75 grams or less of chemical mixture <br />per tube or a total of 200- grams or less for multiple tubes, <br />snakes and glow worms, smoke devices, or trick noisemakers <br />which include paper streamers, party poppers, string poppers, <br />snappers, and drop pops, each consisting of not more than <br />twenty-five hundredths grains of explosive mixture. <br />3) Permit Required. It is unlawful to conduct any indoor fireworks <br />display or to use any pyrotechnic device or materials indoors without <br />first obtaining a permit from the fire chief or fire marshal, consistent <br />with the provisions of the Uniform Fire Code, Sections 7801-7803 <br />(Minnesota Rules Part 7510.3640, as amended from time to time), <br />• except that permits need to be applied for more than three (3) <br />business days in advance of the date of the display or use. <br />si <br />
