42 Section IV: Duties Relating to Right of Subjects <br />The data subject has the right to include a statement of disagreement with disputed data. <br />If an entity determines that challenged data are accurate and/or complete, and the data subject <br />disagrees with that determination, the subject has the right to submit a written statement of <br />disagreement to the responsible authority. <br />The form of the statement of disagreement is of the subject's choosing, and must be included <br />with the disputed data whenever the disputed data are accessed or released. <br />If an entity determines that challenged data are accurate and/or complete, and the data <br />subject disagrees with that determination, the subject has the right to appeal the entity's <br />determination to the Commissioner of Administration. <br />The subject has the right to take this step only after both the subject and the entity have properly <br />completed all the steps in the data challenge process. The subject may appeal only the entity's <br />determination about the accuracy and/or completeness of data. <br />If the entity has given the subject written notice of the right to appeal its determination, the <br />subject must exercise the right to appeal within 60 calendar days. If the entity has not given the <br />subject written notice of this right, the subject has 180 days within which to file an appeal. <br />The requirements for filing an appeal are set out at Minnesota Rules, part 1205.1600, and in the <br />document, CHALLENGING THE ACCURACY AND/OR COMPLETENESS OF DATA THAT GOVERNMENT <br />ENTITIES KEEP ABOUT YOU, at the end of this section. <br />July, 2000 Model Policy: Access to Government Data & Rights of Subjects Data <br />
