PUBLIC IMPROVEMENT <br />SPECIAL ASSESSMENT AGREEMENT <br />AGREEMENT made this day of , 20 , <br />by and between the CITY OF FALCON HEIGHTS, a Minnesota municipal corporation <br />("City") and GRETCHEN DORM, a single person (the "Property Owner"). <br />RECITALS <br />A. Property Owner is the fee owner of following real property located in the City <br />of Falcon Heights, County of Ramsey, State of Minnesota: <br />The West 72 feet of the South 195 feet of Lot 8, Annie L <br />~endrickson's Acre Lots, , subject to Larpenteur Avenue, <br />hereinafter referred to as the "subject property". <br />• B. Property Owner has requested that the City remove a diseased tree from the <br />subject property. <br />NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL <br />COVENANTS THE PARTIES AGREE AS FOLLOWS: <br />1. PUBLIC IMPROVEMENTS. 'The City will remove the diseased tree from <br />the subject property. <br />2. SPECIAL ASSESSMENTS. The City will assess the subject property for <br />the removal of the diseased tree aver 10 years, together with 6 % interest per year on the <br />unpaid balance. The amount of the special assessment is $2742.38. The first installment <br />shall be due and payable with taxes in 2006. The Property Owner waives any and all <br />procedural and substantive objections to the public improvements and special assessments, <br />including but not limited to hearing requirements and any claims that the assessments <br />exceed the benefit to the subject property. The Property Owner waives any appeal rights <br />otherwise available pursuant to Minn. Stat. § 429.081. <br />3. BINDING EFFECT; RECORDING. This Agreement shall be binding <br />upon the Property Owner and the Property Owner's successors and assigns.
