• City of Falcon Heights <br />Planning Commission <br />28 November 1994 <br />Number: 5 <br />ITEM: Consideration of an extension to the moratorium on stores that sell <br />firearms <br />SUBMITTED BY: Susan Hoyt, City Administrator <br />EXPLANATION: <br />In March, 1993 the city council adopted an interim development moratorium on <br />cmmercial uses that the council considered to have possible detrimental secondary <br />impacts on the city's business district and surrounding residential neighborhoods. In <br />March, 1994 the city council adopted a series of ordinances governing several of <br />these uses and removed these commercial uses from the interim moratorium. Only <br />one use, stores that sell firearms, remains under the interim development moratorium. <br />The moratorium currently expires on December 31, 1994. <br />• Over the past months staff has collected information related to statutes and city <br />ordinances controlling the location of stores that sell firearms. This has included <br />having the city attorney discuss the status of regulating these uses with the City of <br />St. Paul city attorney. Staff is continuing to gather information from other cities <br />including zoning regulations and definitions of such stores. <br />At this time staff recommends that the planning commission and city council extend <br />the moratorium on stores that sell firearms until the necessary information can be <br />gathered to develop the appropriate zoning and licensing ordinances to cover this use. <br />An extension until March 31, 1995 should provide ample time for the staff, <br />commission and council to complete this process and adopt the appropriate <br />ordinances. <br />ATTACHMENTS: <br />A -Proposed amendment to Chapter 5 Section 5.04 <br />ACTION REQUESTED: <br />~ Staff review of information being gathered <br />• Recommend amending ordinance Chapter 5 Section 5.04 to extend the interim <br />• moratorium until March 31, 1995. <br />
