She recommended making the conditional use permit broad enough <br />to include secondhand clothing and clothing consignment shops in the event <br />that Mr. Bonner goes out of business, the property owner may lease the <br />business without requesting another conditional use permit. The planning <br />commission must recommend approval of the conditional use permit unless the <br />property owner cannot satisfy all the reasonable conditions governing the use. <br />Commissioner Salzberg moved to recommend to the city council to grant the <br />conditional use permit with the following conditions attached: <br />1. The store be authorized to sell used clothing. The term clothing does not <br />include jewelry or precious metals nor other items defined as secondhand <br />goods in the zoning code. <br />2. The used clothing shall be washed or dry cleaned prior to sale. <br />3. The hours of operation be limited to 9 a.m. to 9 p.m. Sunday through <br />Saturday. <br />4. The proprietor must secure and maintain a business license in Falcon <br />Heights. <br />5. The store shall not exceed the maximum square footage permitted of <br />1,000 square feet permitted in the B-1 district in the zoning code. <br />6. The business shall conform to the city's codes. <br />7. The store shall not receive direct drop off of clothing from members of <br />the public at these premises. <br />8. There shall be no outdoor storage of merchandise. <br />9. The store's parking needs shall be accommodated within the shopping <br />center's parking lot and the immediate public parking spaces along the <br />shopping center and neighboring commercial uses. <br />10. Any change or expansion to the use shall require an amendment to the <br />conditional use permit. <br />
