MINUTES <br />REGULAR PLANNING COMMISSION MEETING <br />NOVEMBER 22, 1993 <br />7:30 P.M. <br />PRESENT: ALSO PRESENT: <br />Kay Andrews Susan Hoyt, Administrator <br />Lee Barry Paul Colton, Planning Intern <br />Tom Brace Peter Bachman, City Attorney <br />Paul Kuettel Paul Ciernia, Council Liaison <br />Ken Salzberg <br />Meeting was called to order at 7:30 p.m. by Lee Barry, Chair. <br />Minutes of September 27, 1993 were approved as written. <br />PUBLIC HEARING ON HOME OCCUPATION CODE CHANGES <br />A public hearing was opened at 7:32 p.m. by Chair Lee Barry regarding the home <br />occupation code. Three changes to the ordinance were presented to the commission <br />to assure that home occupations are permitted in the city, but that they do not <br />detract from the residential character of the neighborhood. The changes as presented <br />to the commission were: <br />1. Clarify the number of trips per day for business use. Staff <br />suggested a maximum of eight (8) two way trips per day for <br />a particular business. <br />2. Determine a percentage of the dwelling to devote to the home <br />occupation. Staff suggests 20%, which is 400 square feet in a <br />2,000 square foot home. <br />3. Eliminate the conditional use permit for home occupations that <br />do not meet the home occupation requirments. This conditional <br />use permit places the city in a position of defining conditions <br />for a possible home occupation. If the conditions are met, <br />the home occupation must be approved. Staff recommended including <br />the line that disabled persons may apply for a waiver of condition <br />through a conditional use permit if the proposed use does not meet <br />the code. <br />After brief discussion, Ken Salzberg moved to adopt the above three recommendations <br />to Chapter 9-14.01 of the city code relating to the home occupation code and Paul <br />Kuettel seconded the motion. <br />• The public hearing closed at 7:50 p.m. <br />
