3. Eliminate the conditional use permit for home occupations that <br />• do not meet the home occupation requirements. This <br />conditional use permit places the city in a position of <br />defining conditions for a possible home occupation. If the <br />conditions are met, the home occupation must be approved. <br />Staff recommends including the line that disabled persons <br />may apply for a waiver of condition through a conditional <br />use permit if the proposed use does not meet the code. <br />Home care facilities like day care, eldercare and group homes are <br />not included as home occupations in the city code, but are <br />permitted in residential zones by state statute, if they meet <br />certain established size requirements. <br />ATTACHIrIENTS <br />4-A Proposed ordinance <br />4-B Memo from DSU dated 8/2/93 <br />4-C Current home occupation code <br />4-D State statute governing location of homecare facilities <br />• ACTION REQUESTED: <br />1.
