<br />PLANNING & DEVELOPMENT 9-11.01 <br />PART 11. "EB" EXISTING BUSINESS DISTRICT <br />9-11.01 !'EB"-Existing Business District <br />Subdivision 1. General. The "EB" District is designed to <br />recognize certain existing non-residential structural land <br />uses which are not in conformity to the Comprehensive <br />Municipal Plan, but which, due to substantial economic <br />investments, soundness of physical structure, vested <br />property rights, or other similar reasons are impractical <br />for reasonable consideration and designation as <br />"non-conforming" uses. Such existing uses which are not in <br />harmony with adjacent and nearby land uses nor in conformity <br />with the Comprehensive Municipal Plan and designated as "EB" <br />under the zoning district map shall be legal, conforming <br />uses under conditions and regulations contained <br />hereinafter; it shall be public policy to strictly regulate <br />and control "EB" uses in the general public interest. Usage <br />shall continue to be permitted as in the B-2 classification. <br />Subdivision 2. Permitted Uses. All uses of structures and <br />land as they existed on the effective date of this Code and <br />a certificate of occupancy has been issued to the fee <br />• owners, occupants, lease holders, and other proprietary <br />interests. Said uses may be continued at the size and in <br />the manner of operation existing. <br />Subdivision 3. Conditional Uses. <br />a. Any change of business, any structural alteration, <br />any change, expansion, or intensification of structural <br />or land use as permitted in B-2 classification and <br />regulated therein. <br />Subdivision 4. Exceptions and Additions <br />a. Prior to the issuance of a certificate of occupancy <br />for new construction, the Planning Commission may require <br />reasonable conditions in the public interest for <br />immediate property improvements such as, removal of junk <br />and debris, installation of screening, building and yard <br />maintenance, and conformity to the performance standards <br />of this code. <br />b. Each "EB" use shall be assigned a conditional use <br />permit number on the effective date of this Code. <br />c. Nothing in this code shall. prevent the strengthening <br />or restoring to a safe condition, any portion of a <br />• building or structure declared unsafe by the city. <br />63 <br />
