• PLANNING COMMISSION <br />MEETING DATE: 6/7/93 <br />AGENDA ITEM: 1 <br />ITEM DESCRIPTION: Public hearing on the proposed amendments to <br />the commercial district's development <br />moratorium, Chapter 5, ~5 of the city code. <br />SUBMITTED BY: Susan Hoyt, City Administrator <br />REVIEWED BY: Peter Bachman, City Attorney <br />Fred Hoisington, Consulting Planner <br />EXPLANATION: <br />As the staff and consultant proceeded with the commercial zoning <br />study begun last fall, it became clear that there are several <br />commercial uses that cannot be easily included or excluded from <br />the city's proposed Snelling and Larpenteur commercial district <br />without determining the statutory authority the city has over <br />certain uses, the possible secondary impacts of certain uses and <br />the best way to control certain uses (i.e. zoning, conditions, <br />licensing). Although the development moratorium on the city's <br />commercial districts currently restricts most of these uses from <br />the city because they are not specifically listed permitted uses <br />in the city's zones, the moratorium will be more effective if <br />these uses are specifically identified for two reasons. First, <br />it will clarify any possible ambiguities in what uses fall. under <br />the moratorium. Second, it will allow the city to remove most of <br />the commercial uses from the development moratorium when the <br />first phase of the zoning study is done and leave the more <br />complex uses under the moratorium until the best way to regulate <br />them is determined. <br />PROPOSED AMENDMENT: <br />This is a proposed list. It doesn't mean that these are all <br />necessary. Please add, delete, comment. <br />Add to Chapter 5 ~5 Subd. 3 <br />c. Certificates of occupancy and business licenses may be <br />granted to any new use that is specifically listed as a <br />permitted use in the applicable zoning district. For <br />purposes of illustration only and without intending to be an <br />exhaustive list, the following uses are not specifically <br />listed as permitted uses in any commercial zoning district <br />and are subject to the moratorium: <br />• <br />
