y- c <br />DRAFT RESOLUTION GRANTING VARIANCE <br />• FOR UNIVERSITY GROVE SUBDIVISION NUMBER 2 <br />On February 22, 1993 the Falcon Heights planning commission <br />recommended the following variances for University Grove <br />Subdivision Number 2, consisting of 2151, 2161, 2173, 2148, 2154, <br />2160 & 2170 Folwell Avenue and 2141, 2147 & 2153 Hoyt Avenue, for <br />approval by the city council: <br />Minor 6 collector street right of way. Chapter 9, Section <br />17.04 Subdivision 2. <br />A variance of 10 feet for Folwell Avenue to permit a 50 foot <br />right of way. <br />Drainage & utility easements. Chapter 9 Section 17.04, <br />Subdivision 4. <br />• <br />A variance to allow no drainage or utility easements along <br />the platted lots of this subdivision. <br />in the variances for Universit Grove Subdivision Num er <br />a. That the variance will not be detrimental to the public <br />welfare; <br />b. That the granting of the variance will not <br />substantially diminish or impair property values or <br />improvements in the area; <br />c. That the granting of the variance is necessary for the <br />preservation and enjoyment of substantial property <br />rights by re-establishing previous property lines and <br />right of ways; <br />d. That the variance will not impair an adequate supply of <br />light and air to adjacent property; <br />e. That the variance will not impair the orderly use of <br />the public streets; <br />f. That the variance will not increase the danger of fire <br />or endanger the public safety; <br />g. That the legal boundary history of the tract is such <br />that strict adherence to the letter of the Chapter <br />would result in undue hardship to the owner. <br />• <br />
