• Meeting Date: 5/18/92 <br />Agenda Item: 1 <br />ITEM: Request for a variance in section 9-2.04[1](c) of the <br />zoning code for 1391 West Idaho <br />SUBMITTED BY: Mr. Lee Barry, Property Owner <br />REVIEWED BY: Susan Hoyt, City Administrator acting as planner <br />EXPLANATION/DESCRIPTION: <br />Mr. Barry is requesting a variance of two feet in the required <br />five foot west sideyard setback of five feet to construct a new <br />double garage in place of an existing single car garage (see <br />attachment A) The current garage is located four feet from the <br />west side lot line. <br />The variance is required to: <br />• To protect a flowering crab tree in the rear yard (If the <br />garage is moved two feet to the east it will require <br />removal or substantial trimming back of the tree). <br />• • To maintain as open a view as possible from the rear <br />windows of the dwelling. <br />If approved the garage will be located three feet from the west <br />side property line which is adjacent to a small garden area and <br />driveway on the neighbor's property. It should not interfere <br />with the visibility from the neighbor's home. <br />Recommendation: <br />Staff recommends approving a two foot variance in the west <br />sideyard setback. The variance request meets the standards for <br />granting a variance (attachment B), specifically c, which will <br />allows for the enjoyment of property rights and g, which provides <br />for preservation of unique site characteristics - the tree and <br />view from the rear of the house. <br />ATTACHMENTS: <br />A - Site plan for 1391 West Idaho <br />B - Standards for granting a variance <br />ACTION REQUESTED: <br />Approve request for a two foot variance in section 9-2.04 <br />• [1](c) of the zoning code in the west sideyard requirement <br />because it meets the conditions for granting a variance <br />specifically c and g. <br />
