Item E-2 <br />ITEM: Request for a variance of 247 square feet from Section <br />9 - 2.04 {2}(b) for 1857 Fairview Avenue in an R-1 zone <br />SUBMITTED BY: Mr. David and Mrs. Susan Thimsen, property owners <br />REVIEWED BY: Susan Hoyt, City Adminstrator acting as planner <br />EXPLANATION/DESCRIPTION: <br />Background <br />Section 9-2.04 [2](b) of the zoning code limits lot coverage of <br />all accessory structures to "not to exceed more than 40$ of the <br />required rear yard (30 ft. deep x lot width) or a maximum of <br />1,000 square feet." <br />Accessory structures are typically detached garages, utility <br />sheds and/or free standing gazebos or screen porches. The limit <br />on lot coverage of accessory structures is necessary to maintain <br />the open space in rear yards in city neighborhoods. Clearly, <br />filling a rear yard with buildings detracts from the residential <br />character of the neighborhood. <br />• The size limit on accessory structures is also useful to help <br />restrict very large garages or pole barns from being built on <br />residential properties. These can detract from the residential <br />character of the neighborhoods, where lot widths vary from 50 to <br />100 feet, and also become used for storage and outdoor businesses <br />that may not be in keeping with single family residential land <br />use. <br />Request for Additional Square Footage for an Accessory Structure <br />The property owners, Mr. and Mrs. Thimsen, are requesting a 247 <br />square foot variance from the 1,000 square foot maximum. (Using <br />the 40~ of required rear yard, the Thimsen's would be allowed a <br />1,278 square feet of accessory structures, but the 1,000 maximum <br />supersedes the 40$).1 The request is necessary for them to put <br />on a four season porch addition of 486 square feet to their <br />existing double garage of 621 square feet (see Figure 1). <br />This would make the garage/porch accessory structure 1,107 square <br />feet, 107 ft. over the maximum allowed. The Thimsen's also have <br />a 140 square foot storage shed in their rear yard so this is <br />calculated into the 1,000 square foot maximum area covered by <br />accessory structures and requires an additional variance of 140 <br />ft. for a total of 247 sq. ft. <br />• 130 ft. required rear yard x 106.5 width @ 40~ = 1,278 sq. <br />ft. <br />
