Meeting Date 4 22 91 <br />Agenda Item F-1 <br />I ~ <br />~J <br />CITY OF FALCON HEIGHTS <br />PLANNING COMMISSION <br />ITEM DESCRIPTION: Proposed revisions to the zoning code <br />9-10. 1 Su 5 (p)(q) including conditions for an amusement <br />establishment and to 9-1.02 Subd. 2 Definitions <br />SUBMITTED BY: Tim Malloy, Consulting Planner <br />REVIEWED BY: City Council <br />Planning Commission <br />Tom Gedde, Attorney <br />Susan Hoyt, Interim City Administrator <br />EXPLANATION/DESCRIPTION: <br />At its March meeting, the Planning Commission reviewed a set of <br />proposed conditions to govern the operation of amusement <br />establishments. The Commission requested the staff to report on <br />the reasonableness of putting these requirements into a license <br />rather than a conditional use permit because (1) they dealt with <br />business operations not the site, and (2) the license is subject <br />to annual renewal. Both Planner Malloy and City Attorney, Tom <br />Gedde, recommend these conditions be in the zoning code where <br />• they are easily administered and where a conditional use permit <br />is necessary to control where amusement establishments locate. <br />Without a conditional use requirement, these establishments <br />would be permitted uses, and not require Planning Commission <br />review and Council approval. <br />In separate discussions, Malloy and Gedde concurred that a <br />condition that terminates the conditional use permit with a <br />chance in business ownership is appropriate and legal in a <br />conditional use permit governing amusement establishments where <br />ownership and management are extremely important. <br />ACTION REQUESTED <br />1.
