• <br />• <br />n <br />Meeting Date 2 25 91 <br />Agenda Item E-1 <br />Attachment 1 <br />MEMORANDUM <br />DATE: February 19, 1991 <br />TO: Planning Commission <br />FROM: Susan Hoyt, City Planner <br />RE: Possible removal of billiard/pool hall and/or game <br />arcades as conditional uses in a B-2 zone <br />BACKGROUND <br />Over the past decade pool halls and game arcade businesses <br />located in Northome shopping center periodically created <br />disruptions in community peace and security. Most recently the <br />City revoked the conditional use permit for J.J.'s Pool and Game <br />Arcade at 1544 West Larpenteur Avenue for failure to meet <br />conditions regarding security in the business and parking lot. <br />Prior to the opening of J.J.'s in 1989, some patrons at the <br />previous came room, Rock-A-Fellas, were so disruptive in the <br />rear parkins lot that several complaints were received from <br />residents living in single family homes adjacent to the <br />property. This history of disruption lead the Planning <br />Commission to request a review of the appropriateness of this <br />use in the City of Falcon Heights. <br />CONDITIONAL USE DESIGNATION <br />The recurring problems with pool halls and/or game arcades is <br />not universal. However, it is common. Therefore, this City <br />designates them as conditional rather than permitted uses in a <br />B-2 zone. The conditional use permit procedure allows the City <br />to analyze the appropriateness of the use for its site, to <br />require measures to assure its conformance to neighborhood and <br />community standards, and, in cases of well documented non- <br />compliance, to revoke the conditional use permit. <br />Similar and additional requirements may also be part of the <br />annual licensing procedure as indicated in Roseville's and <br />Little Canada's proposed ordinances (see Attachments 2 and 3). <br />(Note many of the licensing conditions are similar or identical <br />to those contained in the conditional use permit for J.J.'s.) <br />When considering an application for a conditional use permit, <br />the Planning Commission and City Council cannot deny the permit <br />because they do not like the business or the owner/operator. <br />However, these bodies can deny the permit if they find that it <br />does not meet the standards for granting a conditional use <br />permit, which can include site design and security requirements. <br />Furthermore, it is inappropriate to place unrealistic conditions <br />on an applicant for a conditional use permit.
