Meeting Date 2 25 91 <br />Agenda Item E-3 <br /> <br />CITY OF FALCON HEIGHTS <br />PLANNING COMMISSION <br />ITEM DESCRIPTION: Report on zoning code requirements for <br />re roac ive screening of existing businesses [9-14.01 <br />(5) (b) (d) (e) ] <br />SUBMITTED BY: City Council <br />EXPLANATION/DESCRIPTION: <br />At the October 24, 1990 City Council meeting the Council <br />referred the issue of when and how to apply the retroactive <br />screening requirements for existing businesses to the Planning <br />Commission for its recommendation. due to a full schedule of <br />comprehensive planning activities, the matter was not put on the <br />Planning Commission agenda. <br />It is now time to discuss this issue for two reasons. First, in <br />the larger picture, the comprehensive planning policies stress <br />the importance of retaining neighborhood quality. Maintaining <br />and improving the relationships between commercial and <br />residential land use within neighborhoods is key to this quality <br />issue. Second, on a narrower, but nevertheless, important <br />• point, is the concern of one resident about the impact of the <br />Hamline Auto Repair Shop on the adjacent residential .homes. <br />The attached report defines the retroactive screening issue and <br />its policy implications. At the meeting, staff would like to: <br />1. Summarize the impetus behind this discussion <br />2. Briefly review the report with slides to highlight the <br />broader implications of this ordinance <br />ATTACHMENT 1 - Section 9-14.01(5)(b)(d)(e) <br />ATTACHMENT 2 - Planner's Report <br />ATTACHMENT 3 - City Attorney's opinion on code enforcement <br />ACTION REQUESTED: <br />1. Review and discuss how to apply and/or revise this section of <br />the code to be used to accomplish its intent of retaining and <br />improving neighborhood quality. <br />This requires: <br />o Determining on what basis to enforce <br />o Determining if the Planning Commission should be <br />involved in screening discussions <br />o Determining if effective date should be removed from <br />ordinance <br />
