Second, city staff suggested removing the video <br />games, leaving only pool tables, to reduce the attractiveness of <br />the business to loiterers. Third, city staff suggested closing. <br />the business by 8 p.m. since most assaults/fights happened after <br />8 p.m. <br />OWNERS' RESPONSE <br />The business owners responded to these suggestions by explaining <br />that hiring two uniformed security guards in addition to the one <br />or two employees on site would be financially impossible for the <br />operation. They also indicated that the space in the business <br />was limited, making removal of the video games and leaving only <br />pool tables financially unfeasible. Closing the business at 8 <br />p.m. would also be too costly due to loss of most business. The <br />owners said they were unable to comply with these suggestions to <br />meet the conditions of the conditional use permit. <br />RECOMMENDATION <br />• After these discussions, city staff determined that the business <br />owners' failure to meet conditions three, six, nine, and ten at <br />J.J.s Pool and Game Arcade created a serious disruption in the <br />safety, peace and quiet in the community. The inability of the <br />business owners to financially implement any of the proposed <br />solutions to meet the conditions made it reasonable to pursue <br />the termination of the conditional use permit for J.J.'s Pool <br />and Game Arcade at .1544 West Larpenteur Avenue. <br />PROCEDURES FOR TERMINATION [9-15.04(5)] (Attachment 4) <br />The following steps are taken to terminate a conditional use <br />permit: <br />1. Deliverance of a civil summons to the business owner and the <br />property owner <br />2. Review before the Planning Commission <br />3. Revocation hearing before the City Council <br />4. Vote for termination of the conditional use permit by a <br />majority of the City Council <br />SH/ds <br />• <br />
