Ms. Susan Hoyt
Page 2
September 17, 1990
is a rational basis for the distinction. Therefore it would
appear to be possible for a Minnesota city to limit on-street
parking on certain streets to area residents.
The division of authority on the issue is sufficient such that
the outcome of a legal challenge to any such ordinance cannot
be predicted with certainty. I do believe the City can pro-
ceed with such regulations in good faith, and if it chooses to
do so, can reduce the likelihood of the regulations being
~ challenged, or being found unconstitutional, by careful draft-
ing which addresses the overall public purpose and rat_ Tonal
basis for the legislation.
Yours truly,
HIC~~j GEDDE & SCOTT, P.A.
'mamas A.
