There is a public hearing on a proposed ordinance amending <br />the zoning code, and the Commission will need to vote on a recommendation to the City Council. <br />• The proposed amendments to Chapter 9 were suggested by City Attorney Roger Knutson in order to bring <br />Falcon Heights code into line with Minnesota state law. In 2004, the Minnesota statute was changed to <br />allow owners additional leeway and flexibility with nonconforming structures. This change will make it <br />possible, for example, for certain owners in the Grove who have front yard fences -part of the original <br />home design but illegal under our present code - to restore these architectural features without applying <br />for variances. It will also make it possible to allow certain additions and modifications to existing <br />nonconforming structures, such as homes on the shallow Asbury properties and 1871 Larpenteur, without <br />variances - as long as the addition does not increase the nonconformity. Bottom line: Owners with <br />nonconforming structures will have more freedom to update, maintain and improve those structures. City <br />zoning processes will be streamlined in those cases. Please read the attached documents for details. <br />A public hearing will precede the Commission's deliberation on this ordinance. Notice was published in <br />the Roseville Review at the required time. Mailed notices to property owners were not required and were <br />not sent. No questions or feedback of any kind have been received from property owners in this matter. <br />Training Opportunity: The LMC is offering a training session "Land Use Issues for City Staff, Elected <br />Officials, and Board and Commission Members" in St. Paul on June 15. The session for <br />Commissioners is 6:30 in the evening. This one is highly recommended!
