Staff Recommendation: <br />Staff recommends approval of both variances for the following reasons: <br />1. This property is exceptional in that it shares a parking pact with a nearby property, whose <br />variances depend upon that agreement. No redevelopment of the site can proceed without the <br />cooperation of both owners on parking, vehicle access, landscaping and other issues. That <br />cooperation has been achieved in this plan. <br />2. It would be difficult or impossible for any restaurant to satisfy all zoning requirements on the two <br />lots that do not belong to Falcon Crossing. A balance between landscaping and required parking <br />makes some kind of variance inevitable on this property for this permitted use. <br />3. If the restaurant met the lot coverage and all setback requirements, they would not be able to meet <br />the parking requirements, which would have a much greater impact on the neighborhood. <br />4. Staff and City consultants have worked with the applicants to modify a plan that originally <br />required up to four variances. This plan represents a substantial effort to come as close as <br />possible to the letter of the code while still meeting the needs of a permitted business. <br />5. The plan as submitted is no less in compliance with the City code than the existing conditions on <br />the property, and in fact represents some improvement. A variance of 10.9 feet in front setback <br />2.
