h. Deputies, Agents, Officers. Whenever this Chapter requires an act to be done, <br />which act may legally be done by a deputy, agent, or officer, as well as by the <br />• principal, such requirements shall be satisfied by the performance of such act by <br />an authorized deputy, agent or officer. An employee authorized by his employer <br />to act shall be deemed an agent for the purposes of this provision. <br />i. Conjunctions. The words "or" and "and" may be read interchangeably in <br />situations where the context requires it. <br />j. Minnesota Law to Govern. In the event that this Ordinance conflicts with <br />Minnesota statute or case law, the provisions of the law shall govern. The rules of <br />construction established by Minnesota law shall govern the construction of this <br />Chapter. <br />k. No Consent or Permit Im lied Nothing contained in this Chapter shall be <br />deemed to be a consent, license or permit to use any property or to locate, <br />construct or maintain any building, structure, facility, improvement or to carry on <br />any trade, industry, occupation or activity. <br />1. Provisions cumulative. Except as herein provided, the provisions of this <br />Chapter are cumulative, both with respect to the provisions herein contained and <br />with respect to other laws and ordinances, not in effect or hereafter ordained or <br />enacted, governing the same subject matters as this Chapter. It is noted, however, <br />that the land use districts are mutually exclusive in that uses permitted include <br />. only those listed and are not cumulative from district to district. Land uses not <br />listed as permitted are prohibited. <br />m. Shall: Will. The word "shall" is mandatory and not permissive; the word <br />"may" is permissive. <br />Subdivision 2. Definitions. <br />1. Accessorv Building- A subordinate building, or a portion of the main building, <br />which is located on the same lot as the main building and the purpose of which is <br />clearly incidental to that of the principal building. <br />2. Accessorv Use. A use incidental or subordinate to the principal use of the <br />same land. <br />3. Administrator. The Zoning Administrator of the City of Falcon Heights. <br />4. Adult Uses. Defined but not allowed in an district. Includes the followin <br />a) Adults-only bookstore: An establishment having as a substantial or <br />significant portion of its stock in trade, books, magazines, films for sale or <br />viewing on premises by use of motion picture devices or other coin <br />operated means, and other periodicals which are distinguished or <br />characterized by their principal emphasis on matters depicting, describing <br />3 <br />
