• <br />CITY OF FALCON HEIGHTS <br />No. 95-21 <br />COUNCIL RESOLUTION <br />Date: _ July 12, 1995 <br />------------------------------------------------------------ <br />ARESOLUTION GRANTING A CONDITIONAL USE PERMIT TO OPERATE A <br />SECONDHAND CLOTHING STORE AT 1583 N. HAMLINE AVENUE <br />WHEREAS, the City of Falcon Heights received an application from Dirk Bordsen, <br />owner of the shopping center at 1583 N. Hamline Avenue, on behalf of James Bonner, <br />proprietor of J.T.'s Feathered Denims, for the issuance of a conditional use permit to <br />operate a secondhand clothing store; and <br />WHEREAS, the city council did carefully consider the request on September 28, <br />1994 as well as the recommendations made by the city's planning commission after <br />holding the required public hearing; and <br />WHEREAS, it was determined that the conditional use permit meets all the <br />general and specific requirements set forth in Chapter 9-15.04 subd. 3 (a) of the zoning <br />• code; and <br />WHEREAS, the applicant and proprietor agreed to a number of conditions <br />pertaining to the operation of the business, as noted below; and <br />WHEREAS, the council inadvertently did not pass a formal resolution on that date <br />as required by Ramsey County for recording purposes. <br />NOW, THEREFORE, BE IT RESOLVED, by the city council of the City of Falcon <br />Heights that a conditional use permit for the operation of a secondhand clothing store at <br />1583 N. Hamline Avenue be granted subject to the following conditions: <br />1. The store is authorized to sell used clothing. The term clothing does not include <br />jewelry or precious metals not other items defined as secondhand goods in the <br />zoning code. <br />2. The used clothing shall be washed or dry cleaned prior to sale. <br />3. The hours of operation shall be limited to 9 a.m. to 9 p.m. Sunday through <br />Saturday. <br />4. The proprietor must secure and maintain a business license in Falcon Heights. <br />• 5. The proprietor must operate with a business license and tax identification <br />number, if the tax identification number is required by the State of Minnesota. <br />
