No. R-94-09 <br />CITY OF FALCON HEIGHTS <br />Date 3/9/94 <br />A RESOLUTION GRANTING A CONDITIONAL USE <br />PERMIT FOR BASEMENT STORAGE OF APPROVED ITEMS AT <br />1533 TO 1559 WEST LARPENTEUR, BULLSEYE SHOPPING CENTER <br />WHEREAS, the City of Falcon Heights received an <br />application from Mr. Robert Boyston, Property Manager (on behalf <br />of the property owner American Family Insurance Group, Madison, <br />Wisconsin), for the issuance of a condition use permit to allow <br />storage of approved items at 1533 to 1559 West Larpenteur Avenue; <br />and <br />WHEREAS, the City Council did carefully consider the <br />request as well as the recommendations made by the city's <br />planning commission after holding a public hearing; <br />NOW, THEREFORE, BE IT RESOLVED by the city council of <br />the City of Falcon Heights that a conditional use permit for <br />. basement storage of approved items at 1533 to 1559 West <br />Larpenteur be subject to the following conditions: <br />1. That the shopping center continue to be in <br />compliance with the current Minnesota Uniform Fire <br />Code as it applies to structures of this age and <br />construction including maintenance of sprinkler <br />systems, storage of materials, access and other <br />items identified in the fire code. <br />2. That loading and unloading of storage materials be <br />done in a timely manner to minimize any <br />obstructions in the alley. This loading and <br />C O U N C I L R E S O L U T I O N <br />unloading should be between 8 a.m. and 8 p.m. on <br />Mondays through Fridays, 9 a.m. to 4 p.m. on <br />Saturdays, and prohibited completely on Sundays to <br />minimize disruptions to neighboring property <br />owners. <br />3. That all storage items be light ordinary hazard <br />class and shall not contain mixtures of other <br />hazardous classes, specifically not including <br />items gasoline, oil, batteries, tires and gasoline <br />fired engines and other items considered hazardous <br />by the fire marshal. <br />• 4. That no smoking signs be installed and visible in <br />the storage area. <br />
