• <br />No R-91-8 <br />CITY OF FALCON HEIGHTS <br />C O U N C I L R E S O L U T I O N <br />Date 1/28/91 <br />r ~ <br />U <br />A RESOLUTION ADOPTING THE FINDINGS AND REVOKING THE CONDITIONAL USE <br />PERMIT (RESOLUTION R-89-5 AS AMENDED BY RESOLUTION R-89-18) <br />PREVIOUSLY ISSUED FOR OPERATION OF A GAME ARCADE AT 1544 W. <br />LARPENTEUR AVENUE <br />WHEREAS, the City Council of the City of Falcon Heights <br />adopted Resolution R-89-5 on February 8, 1989, amended by <br />Resolution R-89-18 on August 9, 1989, granting a conditional use <br />permit to allow a game arcade at 1544 W. Larpenteur Avenue in <br />Northome Center, and <br />WHEREAS, upon a routine annual review of the permit by the <br />Planning Commission on December 17, 1990, the Commission <br />determined that Conditions three, six, nine and ten were not <br />being met as evidenced by police records, and <br />WHEREAS, City Staff met with the business owners to discuss <br />proposed solutions to assist the business with meeting the <br />required conditions, and <br />WHEREAS, the business owners explained the suggestions were <br />not financially feasible for their business and that they were <br />unable to meet the conditions, and, <br />WHEREAS, on January 28, 1991, the Planning Commission <br />reviewed the staff report and recommended termination of the <br />conditional use permit, and, <br />WHEREAS, on January 31, 1991, the business owners were <br />delivered a court summons to a revocation hearing on February <br />13, 1991, and, <br />WHEREAS, a duly noticed public hearing was held before the <br />Falcon Heights City Council on February 13, 1991, and <br />WHEREAS, following the public hearing, the Falcon Heights <br />City Council adopted the findings as follows: <br />o that conditions 3, 6, 9, and 10 of the conditional use <br />permit as amended on August 9, 1989, relating to the <br />security of the business and parking lot, the use of the <br />rear exit, and the disruption of community standards of <br />peace and quiet are not being met as evidenced in police <br />reports on 1544 W.
