I <br />- No. R-86-46 <br />CITY OF FALCON HEIGHTS <br />C O U N C I L R E S O L U T I O N <br />• _ Date November 12, 1986 <br />A RESOLUTION RELATING TO AMENDING RESOLUTION 86-41, HARDSHIP DEFERRAL <br />OF SPECIAL ASSESSMENTS FOR SENIOR CITIZENS <br />The City Council of the City of Falcon Heights does resolve as follows: <br />Deferment of Special Assessments for`Senior Citizens The Council may defer the <br />payment of any special assessment on homestead property owned by a person who is <br />65 years of age or older or permanently retired due to disability when payment of <br />the assessment would create a hardship upon the property owner as defined below in <br />Standards of Hardship. The deferment shall be granted upon a certif ication by the <br />owner on a form prescribed by the county auditor supplemented by the city clerk to <br />establish the qualification of the owner for such deferment. The application shall <br />be made within 30 days after the adoption of the assessment roll by the Council. <br />The Council shall either grant or deny the deferment and if granted, the clerk shall <br />notify the county auditor who shall, in accordance with Minnesota Statutes, Section <br />435.194, record a notice of the deferment with the county recorder setting forth the <br />amount of the assessment. <br />Standards of Hardship. A hardship shall be deemed prima facie to exist when the <br />following apply; <br />~e annual gross income of the applicant according to his most recent federal income <br />x return plus his tax-exempt income does not exceed the latest median income as <br />determined by the U.S. Department of Housing and Urban Development. If no such <br />return was made, the Clerk Administrator shall require the applicant to submit <br />other pertinent information to show that this qualification is met. <br />The following guidelines will also be followed: (1) no deferrals of assessments <br />less than $500.00; (2) deferral of principal only, interest must be paid annually. <br />and (3) ten year cap on deferment, however, under unusual circumstances, Council <br />will consider extension. Any determination shall be made in a non-discriminatory <br />manner and shall not give the applicant an unreasonable preference or advantage <br />over other applicants. <br />The option to defer payment of special assessments shall terminate and all amounts <br />accumulated plus applicable interest, shall become due upon the occurrence of any of <br />the following events: (a) the death of the owner, provided that the spouse is otherwise <br />not eligible for the benefits hereunder; (b) the sale, transfer or subdivision of the <br />property or any part thereof; (c) if the property should for any reason lose its <br />homestead status; or (d) if for any reason the taxing authority deferring the payments <br />,..~^ <br />_ Mo~~ed by Councilmember Chenoweth _,!
