• AGREEMENT BETWEEN THE CITY OF FALCON HEIGHTS <br />MINNESOTA, AND MR. V. ELVING ANDERSON <br />AND MRS. CAROL ANDERSON <br />This Agreement is entered into this 22nd <br />May 1984, between the City of Falcon Heights, a municipal corporation, <br />and Mr. V. Elving Anderson and Mrs. Carol Anderson, husband and wife. <br />WHEREAS, Mr. V. Elving Anderson and tZrs. Carol Anderson are the <br />record owners of the following described property located within the City of <br />Falcon Heights: <br />Unplatted lands subject to New Brighton Road <br />the S 94 76/100 ft. of N. 1439 90/100 ft. <br />of E 30 acres of SW 1/4 of Section Lot 16 <br />Townblock 29 Range 23 <br />• <br />WHEREAS, Mr. V. Elving Anderson and Mrs. Carol Anderson, husband <br />and wife, intend to sell said property for residential construction. <br />WHEREAS, the City of Falcon Heights, by Resolution No. 84-16 <br />dated April 25, 1984, imposed certain conditions upon the issuance of a building <br />permit to the Andersons or their assignees for the single family dwelling, due <br />to the possible adverse effects on the structure and surrounding property that <br />could occur from the natural drainage of surface waters in the area; <br />WHEREAS, one of the conditions set forth in the resolution <br />is that the Andersons or their assignees execute an appropriate legal document <br />day of <br />to be prepared by the City Attorney waiving any cause of action they or their <br />• <br />
