CITY OF FALCON HEIGHTS <br />Pursuant to due call and notice thereof, a regular meeting of the <br />City Council of Falcon Heights, Minnesota was held on the 14th day of April, <br />1982. <br />The following members were present: Mayor Warkentien, Council- <br />members Larson, Ciernia and Chestovich , and the following were absent: <br />Councilmember Eggert. <br />Mayor Warkentien introduced the following resolution <br />and moved its adoption: <br />RESOLUTION 82-14 <br />A RESOLUTION AUTHORIZING WITHHOLDING AND ESCROWING <br />OF CONTROVERTED PAYMENTS TO METROPOLITAN WASTE <br />CONTROL COMMISSION <br />WHEREAS, the Metropolitan Council on the 26th day of February, <br />1981, directed the Metropolitan Waste Control Commission to submit a sewage <br />treatment cost allocation attributable to certain lake overflows metered <br />from Lakes Beaver, Como, McCarrons and Phalen; and <br />WHEREAS, said Council on the 6th day of October, 1981, deter- <br />mined to allocate a certain portion of the sewage treatment cost allegedly <br />attributable to said lake overflows to the eight (8) suburban communities <br />of the cities of Falcon Heights, Little Canada, Maplewood, North St. Paul, <br />• Oakdale, Roseville, Vadnais Heights and White Bear Lake and directed said <br />Commission to make charges accordingly; and <br />WHEREAS, said eight (8) suburban communities have instituted <br />proceedings filed in Ramsey County District Court for relief from said <br />charges assessed for treatment of-lake overflows. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />FALCONfEIGHTS <br />1. That the City Clerk Administrator be and hereby is authorized <br />to withhold payment to the Metropolitan Waste Control Commission of those <br />sums charged for the treatment', of lake overflows; and <br />2. That the sums withheld attributable to said treatment of <br />lake overflows be set aside and deposited in an interest bearing account <br />pending further direction of this Council and/or Order of the District <br />Court. <br />The foregoing resolution was duly seconded by Councilmember Larson <br />and upon a vote being taken the following voted in favor thereofc Mayer. <br />Warkentien, Councilmembers Larson, Ciernia and Chestovich , and~tne <br />following voted against the same: None. <br />WHEREUPON, the resolution was declared duly passed and do ed. ~~ <br />• <br />~i.~2. <br />Attes illis C.A.
