CITY OF FALCON HEIGHTS <br />Pursuant to due call and notice thereof, a regular meeting of the <br />City Council of the City of Falcon Heights, Minnesota was duly held at the <br />City Hall in said City on the 27th day of July, 1983. <br />The following members were present: Mayor Warkentien, Council- <br />members Larson, Ciernia, Chestovich and Eggert, and the following were <br />absent: None. <br />adoption: <br />Mayor Warkentien introduced the following resolution and moved its <br />RESOLUTION 83-27 <br />RESOLUTION AUTHORIZING ATTORNEY JOHN BANNIGAN <br />TO MOVE THE RAMSEY COUNTY DISTRICT COURT FOR <br />AMENDED FINDINGS IN THE MATTER PENDING AGAINST <br />THE METROPOLITAN COUNCIL PURUSANT TO RULE 59 <br />OF THE MINNESOTA RULES OF CIVIL PROCEDURES <br />WHEREAS, the City. Council has met with. its Special Counsel, John <br />Bannigan, regarding the status of the lawsuit pending in Ramsey County District <br />Court involving the City as well as other adjacant municipalities and the Metro- <br />politan Council over the cost of managing storm water runoff; and <br />WHEREAS, Mr. Bannigan has reported the adverse decision of Judge Harold <br />Schultz in the above-referenced matter; and <br />• WHEREAS, Mr. Bannigan has determined that there may be facts relating <br />to the City of Falcon Heights which distinguish it from other involved communities <br />which he recommends be presented to the Court in the form of a Motion for Amended <br />Findings; <br />NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Falcon <br />Heights, that St. Paul Attorney John Bannigan be authorized to do the necessary <br />research, prepare appropriate papers and do other things necessary to move the <br />Ramsey County District Court to amend its findings in the recently decised law- <br />suit against the Metropolitan Council so as to accord more favorable treatment <br />to the City of Falcon Heights on the issue of sharing the costs of storm water <br />management. <br />The motion for the foregoing resolution was seconded by Councilmember <br />Larson, and upon a vote being taken the following voted in favor thereof: Mayor <br />Warkentien, Councilmembers Larson, Ciernia, Chestovich and Eggert, and the follow- <br />ing voted against the same: None. <br />WHEREUPON, the Resolution was declared duly passed d adopted. <br />~~. <br />Willis C.
