CITY OF FALCON HEIGHTS <br />Pursuant to due call and. notice thereof, a Special Meeting of the City <br />Council of the City of Falcon Heights, Minnesota was held on the 30th day of <br />November, 1983. <br />The following members were present: Mayor Warkentien, Councilmembers <br />Chestovich, Eggert, Larson and Ciernia, and the following. were absent: None. <br />Mayor Warkentien introduced the following resolution and moved its <br />adoption: <br />RESOLUTION 83-42 <br />A RESOLUTION APPOINTING THOMAS HUGHES, ATTORNEY AT <br />LAW, AS SPECIAL PROSECUTOR FOR THE CITY OF FALCON <br />HEIGHTS <br />WHEREAS, The City of Falcon Heights is required to prosecute all <br />Ordinance Violations, which occur within the City limits; and <br />WHEREAS, the City of Falcon Heights has retained Mr. Jerry Filler as <br />Prosecutor to prosecute said matters; and <br />WHEREAS, from time to time Mr. Filla and the City's Attorneys, Briggs and <br />. Morgan, may have conflicts of interest which prohibit their prosecuting a <br />case; and <br />WHEREAS, it is necessary for the City to expedite processing of all such <br />prosecutions; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Falcon <br />Heights that: <br />1. The City hereby appoints Mr. Thomas Hughes, Attorney at Law, <br />770 University Avenue, St. Paul, Minnesota, as Special <br />Prosecutor on terms which are mutually agreeable to Mr. <br />Hughes and the City. <br />2. The City Administrator is empowered from time to time to <br />assign to Mr, Hughes such matters in which the existing City <br />Prosecutor or the City Attorney may have a conflict. <br />3. Nothing herein shall prohibit the Council from terminating <br />this Agreement by notice to Mr. Hughes and/or assigning <br />matters to any other special prosecutors in the sole <br />discretion of the City. <br />The motion for the adoption of the foregoing resolution was duly seconded <br />• <br />
