CITY OF FALCON HEIGHTS, MINNESOTA Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Falcon Heights, Minnesota was held March 22, 1978, The following members were present: Mayor Warkentien, Council- members Black, McGough, Steele and Brown, and the following were absent: None. Councilmember McGough introduced the following resolution and moved its adoption: RESOLUTION 78-12 A RESOLUTION ESTABLISHING A POLICY STATEMENT CONCERNING SEWAGE BACKUP WHEREAS, the City of Falcon Heights has collector sanitary sewer lines within certain easements throughout the City and, WHEREAS, private and commercial property owners are permitted to connect to lines for the purpose of disposing sewage and, WHEREAS, from time to time blockage will occur in the City lines causing backup into private property and, WHEREAS, the City is insured due to their own neglect when and if said insurance company so determines and, WHEREAS, if the insurance determines damage was not due to city neglect the following proceedures shall be followed by the administrative staff as follows: 1. The City does not. have adequate maintenance personnel or equipment to provide cleanup for individual property owners. It would be unfair to provide assistance in some situations and not in others. 2. The City recommends that property owners obtain professional assistance in clean up sewage backup debris, if necessary. 3. If it is subsequently determinded that the sewage backup was the responsibility of the City of Falcon Heights; (a) Bills will be submitted to the City's insurance. company for payment: and (b) In the event the insurance company refuses payment, property owners may file a claim against the City in accordance with statutory procedures.. This is solely a statement of policy by the City of falcon Heights concerning the problem of sewage backup. Nothing contained in this statement shall contain an admission ~y the City that its. insurance carrier will pay .any particular claim or that the City will pay any particular claim filed against it. Payment or claims by either the City or its __ liability carrier are to be determined on an individual basis.
