CITY OF FALCON HEIGHTS, MINNESOTA <br />Pursuant to due call and notice thereof, a regular meeting <br />of the City Council of the City of Falcon Heights, Minnesota was <br />held March 22, 1978, <br />The following members were present: Mayor Warkentien, Council- <br />members Black, McGough, Steele and Brown, and the following were <br />absent: None. <br />Councilmember McGough introduced the following resolution and <br />moved its adoption: <br />RESOLUTION 78-12 <br />A RESOLUTION ESTABLISHING A POLICY <br />STATEMENT CONCERNING SEWAGE BACKUP <br />WHEREAS, the City of Falcon Heights has collector sanitary <br />sewer lines within certain easements throughout the City and, <br />WHEREAS, private and commercial property owners are permitted <br />to connect to lines for the purpose of disposing sewage and, <br />WHEREAS, from time to time blockage will occur in the City <br />lines causing backup into private property and, <br />WHEREAS, the City is insured due to their own neglect when <br />and if said insurance company so determines and, <br />WHEREAS, if the insurance determines damage was not due to <br />city neglect the following proceedures shall be followed by the <br />administrative staff as follows: <br />1. The City does not. have adequate maintenance personnel <br />or equipment to provide cleanup for individual property <br />owners. It would be unfair to provide assistance in some <br />situations and not in others. <br />2. The City recommends that property owners obtain professional <br />assistance in clean up sewage backup debris, if necessary. <br />3. If it is subsequently determinded that the sewage backup <br />was the responsibility of the City of Falcon Heights; <br />(a) Bills will be submitted to the City's insurance. <br />company for payment: and <br />(b) In the event the insurance company refuses payment, <br />property owners may file a claim against the City in <br />accordance with statutory procedures.. <br />This is solely a statement of policy by the City of falcon <br />Heights concerning the problem of sewage backup. Nothing <br />contained in this statement shall contain an admission ~y <br />the City that its. insurance carrier will pay .any particular <br />claim or that the City will pay any particular claim filed <br />against it. Payment or claims by either the City or its <br />__ liability carrier are to be determined on an individual basis. <br />
