<br />Mn/DOT 30780 (Revised 11/78) <br />STATE OF MINNESOTA <br />DEPARTMENT OF TRANSPORTATION <br />TECHNICAL AND ENGINEERING ASSISTANCE AGREEMENT <br />THIS AGREEMENT, made and entered into by and between the State of <br />Minnesota acting through its Commissioner of Transportation, hereinafter re- <br />ferred to as the "State", and the County or City of Falcon Heights <br />hereinafter referred to as the "User", WITNESSETH: <br />WHEREAS, the User, as evidenced by Resolution, a copy of which is at- <br />tached hereto and made a part hereof as Exhibit A, does hereby request the <br />State to furnish from time to time as needed and specifically requested, tech- <br />nical and engineering assistance pursuant to M.S. 161.39: and <br />WHEREAS, The State is authorized to provide technical and engineering <br />assistance to other road authorities by M.S. 161.39. <br />• NOW, THEREFORE, it is mutually agreed by the parties hereto that: <br />1. The State may, upon written request by the User, provide technical <br />and engineering assistance and such other services as authorized by M.S. 161.39. <br />2. The State shall keep a record of its costs and expenses, including <br />overhead costs, in providing assistance and services to the User pursuant to <br />Paragraph 1 above, and shall prepare an itemized statement thereof showing the <br />amountt due hereunder and submit the same to the User on a~periodic basis. <br />3. The User agrees to pay to the Trunk Highway Fund of the State of <br />Minnesota all monies due hereunder and as shown by the invoices or statements <br />submitted to the User, within 30 days after such submission. <br />4. This Agreement is subject to cancellation by any party upon 60 <br />days written notice. <br />IN WITNESS WHEREOF, the State and the User have caused these presents <br />• to be executed by their respective officers. <br />Page No. 1 <br />
