AGtiY;EMEN`P ~'OR 1tU51LAWN ~`1Vr;NUF 1'MYROVH:MENT • FROM CL~;VELATdU AVlaiVUE `i'0 FAIRVlEW AVENUE This Agreement by and bi'tween the City of Falcon Heights, irlinnesota, a municipal corporation, hereinafter referred to as the "City," and the County of Ramsey, a political subdivision of the State of Minnesota, hereinafter referred to as the "County"; WTTNf;SSETH : WHEREAS, The County, the City of Roseville, and the City desire to construct and rebuild iosr:Z.~ew ~ ~~vt~nt.~:~ (County Road 114) between Cleveland '~ Avenue and r'airviety Avenue: ; a.iu WHEREAS, The County has heretoi'ore prepared plans and specifications for said improvement, including therein necessary road grading, base, bit wninous pavement, concrete curb and gutters, storm sewer, utility modifications, retaining walls and water main insulation; NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLIAWS: 1. The County shall prepare the necessary proposals, take bids, tabulate bids, and with concurrence of the City shall award a contract for the construction of this project, County Project No. 114-02, Roseville Project No. M.S.A.P. 160-21+3-02, City Project No. M.S.A.P. 124-103-02; the • County shall perform the construction inspection. 2. The City shall acquire and pay for additional permanent rights of way and temporary easements required for the construction of the roadway within the City in accordance with the plans and specifications. The County sha11 prepare the right of way acquisition documents. All rights of way shall be in the name of the County. 3. As its portion of the improvement, under County Project No. 114-02, the cost of the center 24 feet of roadway, except for utility modifications, shall be borne by the County alone. 4. The City shall pay 100 percent of the cost of its utility modifications and retaining walls within the City. 5. The City shall pay 100 percent of the cost of the bituminous path. 6. All remaining costs shall be borne equally by the City of Rosevil.i.e and the City. 7. The City will pay y0 percent of its share of the cost to the Treasurer of Ramsey County, Minnesota, after award of the contract and approval of con- tracts by the Minnesota Department of Transportation, and the contractor shall then be paid by the County according to the contract terms. All monies paid by the City and not expended on the project will be returned within a reasonable . time, not to exceed two (2) years from deposit. -1-
