preceded by a hearing before the City Council, with not less <br />than 10 days' notice to the licensee. <br />Section 27.5 Interference with, or Hinderance of, <br />Health Autho-rit No person shall interfere with or hinder <br />any Health Authority in the performance of his duties under <br />this Resolution or the laws of the State of Minnesota, nor <br />prevent his performance thereof. <br />Section 27.6 Temporary Suspension of License. <br />The Health Authority with the approval of the C1!er_1~Adminis- <br />trator shall immediately suspend the license of any food <br />establishment for the violation of any terms of this Reso- <br />lution if such violations constitute an imminent public health <br />hazard.. Upon notification by the Health Authority of a tem- <br />porary suspension of license by posting of his report as set <br />forth in this Resolution at the time of the inspection, the <br />licensee shall forthwith cease operation. The licensee may <br />appeal the temporary suspension in writing to the City Council <br />which shall act forthwith to either ratify the acts of the <br />Health Authority or to remove the suspension. Temporary <br />suspension may result in revocation or extended suspension <br />of the license as provided in Section 27.4. Upon notifica- <br />tion in writing. by the licensee to the Health Authority that <br />all violations have been corrected, for which temporary <br />suspension was invoked, the Health Authority shall reinspect <br />the food establishment within a reasonable length of time. <br />If all violations constituting the grounds for the temporary <br />suspension have been corrected, the Health Authority shall <br />forthwith terminate the suspension. <br />The Health Authority and the Clerk-Administrator <br />shall not suspend a license if the violation or violations <br />which constitute an imminent public health hazard can be <br />eliminated or removed by embargo or condemnation as provided <br />in this Resolution. <br />SECTION 28 - SEPARABILITY <br />Section 28.T Separability. Should any section, <br />subdivision,. clause, or other provision of this Resolution <br />be declared by a court of competent jurisdiction to be <br />invalid, such decision shall not affect the validity of the <br />Resolution as a whole nor of any part thereof other than the <br />part so declared to be invalid. <br />This Resolution shall be effective upon passage. <br />Adopted by the City Council this 24th day of <br />- 22 - <br />
