MINUTES <br />PLANNING COMMISSION MEETING <br />JULY 7, 1980 <br />• <br />The Meeting was called to order at 7:30 p.m. by Al Stefanson in the absence of <br />Chairman Les Larsen. Commission Members present were Jerry Wallin, Harold Nilsen, <br />Elving Anderson, Erma Olson, Al Stefanson, Bob Blomberg, and Jim Bourquin. Present <br />for the City Council was Helen Brown. <br />The first item of business was consideration of a variance request submitted by <br />Karen and Henry Panowitsch. They submitted a permission letter from Maureen and <br />Richard Willard, their neighbors to the south. The Commission reviewed Ordinance <br />No. 64, specifically .Section 7.4. Harold Nilsen was of the opinion that the <br />Panowitsch residence was a one story residence within the meaning of Section 7.4. <br />As the mayor at the time Ordinance No. 64 was adopted, Harold Nilsen stated the <br />Panowitsch residence was not intended to fall within the two story classification <br />as contemplated by the Ordinance. Nilsen moved that. the matter be referred to the <br />City Council with the Planning Commission's recommendation that Mr. and Mrs. <br />Panowiisch receive a refund of :their $10.00 variance application fee, the Planning <br />Commission being of the opinion that no variance was required by Section 7.4 of <br />the Zoning Ordinance upon the proviso that the .garage extension to be constructed <br />on the Panowitsch property remain at least 5 feet or more from the south property <br />line. Jerry Wallin seconded the motion. Those in favor were Nilsen, Anderson, <br />Wallin and Stefanson. Those opposed were Blomberg and Olson. The motion was <br />carried. <br />Item No. 2 on the agenda was the consideration of a conditional use permit <br />. application by Thomas W. Barron, .1905 Arona Ave., for the purpose of constructing <br />a swimming pool in their back yard. Upon consideration of the submitted plans <br />and a review of the Zoning Ordinance No. 64 and the Swimming Pool Ordinance 465 <br />the Planning Commission was of the opinion that Section 6.3 of the Zoning Ordinance <br />provided that a swimming pool in an R-1 zoned property is a permitted use not re- <br />quiring a conditional use permit. Ordinance No. 65, in the opinion of the Planning <br />Commission, requires only an adherence to the applicable plumbing code and not a <br />conditional use permit. Nilsen again moved that the matter be referred to the <br />City Council with a recommendation that-.the swimming pool permit required under <br />Ordinance N0. 65 be issued and the the $10.00 conditional use permit application <br />fee be refunded upon the following grounds: <br />1. The Zoning Ordinance does not consider a swimming pool on R-1 zoned <br />property to be a conditional use; <br />2. Ordinance No. 65 does not establish a requirement for a conditional <br />use permit. <br />Comprehensive Planner Carl Dale appeared and advised the Commission as follows: <br />a. Metro Council has granted the City's application for a six month extension <br />to allow surrounding communities and the Council to review the Comprehensive Plan. <br />b. Updated and revised Comprehensive Plan texts were distributed and the old <br />copies were returned. The map series to go with the text is not yet quite complete <br />but will be available by the July 23, 1980 Public Hearing. <br />c. Carl conducted a slide show depicting traffic and aesthetic problems <br />existing within the business district. It was informally agreed among the Planning <br />Commission .that Mr. Dale should present a similar slide show at the Public Hearing <br />scheduled for 7:00 p.m, on July 23. <br />
