MINUTES <br />PLANNING COMMISSION MEETING <br />NOVEMBER 2, 1981 <br />• The meeting was called to order at 7:00 p.m. by Chairman Stefanson. Also <br />present were Olson, Bourquin, Mead, Nilsen, Wallin, Blomberg, Labalestra, <br />Waldo, and Council Liaison Sandy Larson. Also in attendance were Mayor <br />Warkentien, Councilmembers Steele, Brown and Eggert, City Planner Carl <br />Dale, City Engineer Brad Lemberg and City Attorney David Allen. <br />The first item of business was the variance request of Robert Butala, 1530 <br />W. Iowa, to permit construction of a driveway 22 feet from his east property <br />line. Butala distributed a prepared statement and a listing of several points <br />in support of his application. Among the points in support were the following: <br />1. There is existing precedent within the City for permitting the request. <br />2. The proposed use is consistent with R-1 permitted uses. <br />3. Denial would place a hardship on the growing Butala family. <br />4. The proposed use is a practical and realistic approach to the <br />current economic and housing conditions. <br />5. Three out of four adjacent property owners are not in opposition. <br />Mrs. Leah Johnson, 1524 W. Iowa, spoke in opposition to the requested variance. <br />She was concerned that a reduction of her property value would result. Her <br />opposition-was,. in all respects, emphatic, and she stated several times that <br />she did not want such a driveway next to her property. There was a motion by <br />Olson-that the application for a variance, as regeusted, be recommended to the <br />City Council for approval. A second was offered by Labalestra, whereupon a <br />roll call vote was taken. Those in favor .were Olson, Mead, Labalestra, Waldo <br />. and Wallin. Opposed were Bourquin, Nilsen, Stefanson and Blomberg. The motion <br />carried by a vote of 5 to 4. <br />The next item of business was the rezoning request of American Shelter Corpo- <br />ration. This request sought to rezone the property immediately to the north <br />and west of Hewlett-Packard to a combination of B1A and R3. In support of <br />this request larger scale drawings were presented showing residential con- <br />struction consisting of townhouses and condominiums. Also included in the <br />plan was a surface water containment plan calculated on the basis of a 1G0 <br />year storm. The proposed densities were 7.61 townhouse units per acre and <br />13.9 condominium units per acre with an average density of 10.18. Carl <br />Dale commented generally as follows: <br />1. The B1A portion is consistent with the Comprehensive Plan. <br />2. R3 zoning would allow for up to 20 units per acre. <br />3. Still thinks PUD zoning would be in everybody's best interests. <br />Carl also commented by letter generally along the lines that anything less <br />restrictive than PUD would not afford the City adequate control over this <br />proposed project. <br />Brad Lemberg confirmed that the 100 year storm calculation checked out and <br />stated that the street plan was better. <br />In the midst of the discussion of American Shelter's rezoning .request, <br />• Nilsen proposed a resolution to study surface water run. off in the proposed <br />building site and surrounding environs. Lemberg said the study had been <br />done in 1974. Nevertheless the resolution was unanimously carried and the <br />City Council is requested to consider acting in accordance with the reso- <br />lution. <br />
